Pastor and church who sent YouTube DMCA takedown notices for videos of sermons posted on operator’s channel had good faith belief that videos were infringing.
An ongoing dispute between a church and its pastor and a YouTube channel operator has been put to rest by the U.S. Court of Appeals in Atlanta, which affirmed the district court’s grant of summary judgment in favor of the church and pastor, finding that it was not shown that they made a knowing misrepresentation of copyright infringement nor that there had been an abuse of process. Accordingly, the channel operator could not go forward with misrepresentation claims under the Digital Millennium Copyright Act (Johnson v. New Destiny Christian Center Church, Inc., September 4, 2020, per curiam).
